Family Law/Divorce

Child support is the legal obligation of parents to contribute to the expenses of children of the marriage.

Custody is the care, control and maintenance of a child awarded by the court to one of the parents.

Visitation is the noncustodial parents’ right of access to his or her child, meaning his or her rights to see and spend time with the child or children, and to build and maintain a relationship with the child or children.

Legitimation is the process to assure inheritance rights to a child or to place a child born before marriage on the footing of those born in lawful wedlock.

Restraining orders are injunctions filed against a defendant forbidding them from committing a threatening act. In addition, it prevents all contact by the defendant with the party requesting the order.

Adoption is the process to take into one’s family the child of another and give him or her rights, privileges and duties of a child.

Contested Divorces are litigated cases where the issues are usually decided in court by judge or jury.

Uncontested divorce is an agreement settling all issues involving child custody, child support and property distribution.

Plaintiff is a person who brings an action.

Defendant is the person defending or denying the action brought by a plaintiff.

Petitioner is the person who presents a petition to a court, officer or legislative body. In addition, he is the one who starts an equity proceeding or the one who takes an appeal from a judgment.

Respondent is the part in equity practice who makes an answer to a bill or other proceeding in equity.
